MHDCS Rules 2004

1. TITLE AND OBJECTS: The club shall be called the Market Harborough & District Canine Society and its objects shall be to promote interest in Obedience Training, Ringcraft and Agility, and to serve the interests of the public in this area.

2. OFFICERS AND COMMITTEE: The club shall consist of Chairman, Vice Chairman, Secretary, Treasurer, Show Secretary, a committee of twelve and an unlimited number of members.

3. LENGTH OF SERVICE OF OFFICERS: The term of Officership will be for a period of three years on a rotation basis.

4. COMMITTEE: The management of the club shall be in the hands of a Committee consisting of seventeen members, of whom the Chairman, Vice-Chairman, Secretary, Treasurer and Show Secretary shall be ex-officio members. The committee shall retire annually, but shall be eligible for re-election. Meetings of the committee shall be held as often as is deemed necessary and 50% including one ex-officio member shall form a quorum for the transaction of business. Any committee member absent for three or more committee meetings (consecutive) without reasonable excuse shall be removed from the Committee and shall not be eligible for re-election unless the Committee find otherwise. Sub-committees may be formed at the discretion of the main Committee with at least one member of the main Committee.

5. ELECTION OF COMMITTEE: The election of five officers and twelve Committee members shall take place at the Annual General Meeting. Nominations for Officers and Committee for the ensuing year must be submitted to the Secretary, in writing, not less than seven days before the Annual General Meeting. Nominations are on the distinct understanding that the proposer has secured the prior consent of the nominee/s to take up office if elected, and that such proposer, seconder and nominee shall be fully paid up members of the club at least twelve months before the ballot. Any casual vacancies occurring in the Committee in any year may be filled by the Committee with a fully paid up member. Each discipline shall be proportionately represented on the Committee i.e.: each section has a maximum of four Committee members. The Committee reserve the right to co-opt up to six members extra to the Committee should it be deemed necessary.

6. MEMBERSHIP: Membership shall be open to all. Young persons under the age of 16years may be admitted as Junior Members. Such Junior Members shall enjoy all the privileges of membership except that they shall not be eligible to vote at General Meetings or sit on the Committee.

7. SUBSCRIPTIONS: The annual subscription shall be 30p for Junior Members, £2.00 for Adult Members and £2.50 for Adult Joint Members (any two of the same family). Subscriptions are payable to the Treasurer on January 1st each year, and membership should be paid by 31st January that year for a member to be eligible to attend the A.G.M. and vote. Membership commences on the date of the annual subscription. No member whose subscription is unpaid shall be entitled to participate in the voting or be entitled to any of the privileges of membership. If any member shall fail to pay the Annual subscription by March 1st, the Committee shall have the power to erase his/her name from the list of members, but if the Committee shall subsequently receive a satisfactory explanation, the member may, at the discretion of the Committee and on payment of arrears be re-admitted to membership, provided the membership has not elapsed for a period exceeding twelve months. Anyone becoming a member after October 1st in any one year is covered until December 31st the following year.

8. CLUB PROPERTY: The property of the club shall be vested in the Committee and in the event of the club ceasing to exist, a General Meeting shall be called to decide the disposal of assets.

9. EXPULSION OF MEMBERS: Any Member who shall be suspended under Kennel Club Rule A42j(4) and/or any member whose dog(s) is/are disqualified under Kennel Club Rule A42j(8) shall ipso facto cease to be a Member of the Society for the duration of suspension and/or disqualification.

If the conduct of any member shall, in the opinion of the Committee of the Society be injurious, or likely to be injurious, to the character or interests of the Society, the Committee of the Society may, at a meeting, the notice of which includes as an object the consideration of conduct of the member, determine that a Special General Meeting of the Society shall be called for the purpose of passing a resolution to expel him. Notice of the Special General Meeting shall be sent to the accused member, giving particulars of the complaint and advising him of the place, date, and hour of the meeting that he may attend and offer an explanation. If, at that meeting, a resolution to expel him is passed by two third majority of the members present and voting, his name shall be forthwith erased from the list of members, and he shall thereupon cease, for all purposes, to be a member of the Society, except that he may, within two calendar months from the date of such meeting, appeal to the Kennel Club upon, and subject to, such conditions as the Kennel Club may impose.

10. GENERAL BUSINESS: The Financial year for the Society shall be from January 1st to December 31st each year. Members shall receive at least 14 days prior notice of an Annual General Meeting or Special General Meeting. Notice of an A.G.M. or S.G.M. will be given in writing to every fully paid up member. It will also appear in the local press as an attachment to the regularly placed advertisement, and as a notice at the venue of each discipline. The Annual General Meeting shall be held in the first quarter of the year for the purposes of receiving the report of the Committee and the statement of accounts, to elect Officers and Committee, and to discuss any motion duly placed on the agenda of which prior notice has been given to the Secretary. No business shall be transacted at the Annual General Meeting unless notice thereof appears on the agenda with the exception of routine matters of those which, in the opinion of the Chairman of the meeting, are urgent. Any items for the Agenda of the Annual General Meeting must be received in writing by the Secretary not later than seven days before the date of the meeting. The election of Officers and Committee at the Annual General Meeting shall be either by vote or ballot of those present at the Meeting. At a Special General Meeting 10% of fully paid up members shall form a quorum. Two-thirds of votes cast shall be necessary to carry a resolution.

The rules of the Society shall not be altered except at an Annual General Meeting or Special General Meeting. Any alteration to the rules shall not be brought into force until the Kennel Club has advised and given its approval of alterations. In the event of an equal vote, the Chairman of the meeting shall have the casting vote.

11. CLUB ACCOUNTS: A banking account shall be opened in the name of the Society into which all revenues of the Society shall be paid, and from which withdrawal shall only be made on the signature of two or more Officers, or one Officer and one nominated Committee member. The accounts shall be kept by the Treasurer, and one qualified Accountant or two unqualified individuals with accountancy experience shall be appointed at each A.G.M. who shall audit the Society's accounts for the ensuing year before the A.G.M.

12. ANNUAL RETURNS TO THE KENNEL CLUB: The Officers acknowledge that during the month of January each year Maintenance of Title Fee will be forwarded to the Kennel Club by the Secretary for the continuance of registration and that the 31st July each year, other returns, as stipulated in the Kennel Club Regulations for the Registration and Maintenance of Title of Societies and Breed Councils and the Affiliation of Titles of Societies and Municipal Authorities, will be forwarded to the Kennel Club.

The officers also acknowledge their duty to inform the Kennel Club of any change of Secretary of the Society which may occur during the course of the year.

13. DISSOLUTION OF THE SOCIETY: Should, in the opinion of the Committee, the Society be unable to continue to function, a Special General Meeting shall be called to discuss the matter further.

14. FINAL APPEAL: The Kennel Club shall be the final court of appeal in all matters of dispute.

15. LIST OF MEMBERS: The Society will make a list of members and their addresses available for inspection if so requested by the members of the Society or the Kennel Club.

16. The Society shall not join any federation of Societies or Clubs.

17. No person whilst an un-discharged bankrupt may serve on the Committee of or hold any other office or appointment within a Kennel Club Registered Society.
